These Terms of Service ("Terms") govern your access to and use of speedtheweb.org (the "Site") and any website design, development, or performance services provided by Speed The Web ("we", "us", or "our") (ABN 23 692 606 607).

By accessing the Site, contacting us, or engaging our services, you agree to these Terms. If you do not agree, do not use the Site or our services.
Services
We provide website-related services, which may include design, development, performance optimization, hosting guidance, and related consulting. Specific deliverables, timelines, and pricing will be set out in a written proposal, statement of work, or email agreement (the "Agreement").
Quotes, deposits, and payments
- Quotes are valid for: 10 business days unless stated otherwise.
- We may require a deposit before commencing work.
- Invoices are due: on receipt.
- Late payments may pause work until the account is brought up to date.
Client responsibilities
- Provide timely access to content, brand assets, and approvals.
- Ensure you have rights to all materials you provide (text, images, trademarks, etc.).
- Review deliverables promptly and provide feedback by agreed dates.
Intellectual property
Unless otherwise agreed in writing, we retain ownership of our pre-existing materials, tools, and know-how. Upon full payment, you receive a license to use the deliverables provided under the Agreement for your business purposes. Any third-party assets (fonts, plugins, stock imagery) remain subject to their respective licenses.
Changes and revisions
Reasonable revisions may be included depending on the Agreement. Requests outside scope may require a change order and additional fees and time.
Third-party services
Your project may rely on third-party services (such as hosting providers, analytics, payment processors, or email services). We are not responsible for third-party outages, changes, or terms. You are responsible for maintaining your accounts and complying with third-party terms.
Disclaimer
The Site and services are provided on an "as is" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Site or services will be limited to the amount you paid us for the relevant services under the Agreement, unless required otherwise by law.

Our collection and use of personal information is described in our Privacy Policy.
Termination
Either party may terminate an Agreement as described in the Agreement or by written notice if no terms are specified. Fees for work completed and costs incurred up to termination remain payable.
Governing law
These Terms are governed by the laws of: [State/Territory, Australia]. The parties submit to the exclusive jurisdiction of the courts in that place.
